Sogno’s Terms and Conditions

Sogno is a multi-purpose venue, managed by Sogno Group Limited, for events and a range of services, e.g. using the facilities of rehearsal studios, bedroom studio, trio and acoustic studios, mixing and editing room, rehearsal space in accordance with the policies and procedures.

In using this website and or making a reservation booking, you are deemed to have read and agreed to the following terms and conditions.

Terminology

The following terminology applies to these Terms and Conditions, the Company’s Privacy Policy and House Rules:

"Members" means “One-Day Member”, or “Individual Member” and “Team Member” on a daily, monthly or yearly basis, or any person accessing this website and accepting the Sogno’s terms and conditions.

"The Company", “we” and "us", means – Sogno (as managed by Sogno Group Limited).

“Credit Unit” means the amount of unit (one credit unit = HKD 10.00) you purchased as a registered member for the right to access our services.

Except where the context otherwise requires, words importing the singular shall include the plural and vice versa; words importing a gender shall include all other genders; references to any person shall include any individual, firm, body corporate (wherever established or incorporated).

Sogno (being “we“ or “us”) recognises its responsibilities in relation to the collection, holding, processing, use and or transfer of personal data under the Personal Data (Privacy) Ordinance (Cap. 486) ("PDPO").

Personal data will be collected only for lawful and relevant purposes and all practicable steps will be taken to ensure that personal data held by us is accurate. Please see the latest version of the Privacy Policy.

Exclusions and Limitations

The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, the Company excludes all representations and warranties relating to this website and its contents and all liability and loss of any nature for damages arising out of or in connection with your use of this website. The exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.

Warranties and Liabilities

Unless otherwise stated, the services featured on this website are only available within the

Sogno, Hong Kong SAR. All advertising is intended solely for the Hong Kong market. You are solely responsible for evaluating the fitness for a particular purpose of any download, program and text available through this site.

Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of the Company.

The Company does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you shall thereby indemnify this Company, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

Payments

All major Credit Cards or PayPal are acceptable methods of payment for our members. Payment shall be made in full when you purchase our service. Deposit payment shall be paid when you wish to order Consignor Products at our premise. All goods shall remain the property of the Company until it is paid in full.

Membership Subscription

Our membership schemes are SaaS (Subscription as a Service) only, i.e. on a daily, monthly basis. There is no fixed starting date. It commences when the membership subscription is fully paid.

The access right or amount of useable credit unit will depend on the membership scheme you choose. Membership scheme credit unit cannot be carried forward to the next month’s subscription. The credit amount shall refresh to its original stated amount on the start date of the monthly subscription.

Termination and Refund Policy

Both you and Sogno have the right to terminate any Service with or without any reason, including the ending of services that are already underway. Payments of all membership schemes are non-refundable.

Cancel or Amend Membership

You can cancel the membership at any time. In any case, your membership shall will continue to be effective until the end of its membership period.

Your existing membership account will not be deleted even a member subscription is cancelled as the right of access will be resumed once the membership subscription is fully paid again.

You can change the membership scheme at any time through our website or app - Members Center. The payment date will start when the next membership subscription period and right of access will change accordingly. We will process the change within three (3) working days according to the request.

As members of a Team Membership plan scheme, you can amend the membership plan through their main account - who is responsible for the subscription payment. We will process the change within three (3) working days according to the request.

As an individual plan member (Hot Desk, Flexible and Full Membership), you are required to create another member account in order to join a Team Membership plan, or the other way around. No credits shall be transferred between your personal account and your Team Membership account.

Facilities Booking

There are a range of facilities available for booking at Sogno. These include Rehearsal Studios (A, B), Trio & Acoustic Studios (C, D, E), Bedroom Studio, Mixing & Editing Room, and Rehearsal Space.

Advance booking for facilities is available from the event date and time to seven (7) days later on any day. However, recording sessions will have to be booked at least three (3) days prior to the event date and time. Please refer to the House Rules for more details on booking arrangement or procedure.

Members’ Event Admission

Event admission fee is generally divided into existing member and one-day member. Please note that the access rights within Sogno, the entry fee and other rights granted by the admission will be different between those two members.

Cancellation is not available for any purchase of members’ event entry, and the entry fee will be non-refundable for both existing member and one-day member, and the entry access right will not be transferable.

As an existing member, you can use your own credit unit to join the event. One-day member will have to create an account as a one-off purchase for the event day till the close of business at 6:00 A.M. of the next day.

Marketplace Consignment Products

Marketplace consists local consignors providing hand-made music-related products. Such products will be charged at the price suggested by consignors, and members may purchase the products and pay through the ‘Shop’ section at our Members Center. The price will be subject to their conditions, materials, sizes, finishes, etc. as quoted by the consignors.

Warranty of marketplace products will be subject to the terms of the specific consignor’s suggestion, and Sogno is not liable for any damage or loss, including defects and or quality of the products. Please also see detail of the “Market” section as described in the House Rules.

Copyright and other relevant intellectual property rights exists on all text relating to the Company’s services and the full content of this website. This Company’s logo is a registered trademark of this Company in the United Kingdom and other countries. The brand names and specific services of this Company featured on this web site are trademarked.

Force Majeure

We shall not be responsible for delays or failures in performance resulting from acts beyond our control. Such acts shall include but not be limited to acts of God, strikes, lockouts, riots, acts of war, epidemics, governmental regulations superimposed after the fact, fire, flood, tropical cyclone, inclement weather, communication line failures, computer viruses, power failures, earthquakes or other disasters.

Governing Law

These terms and conditions shall be governed and construed according to the Laws for the time being in force in Hong Kong SAR.
